In Orgeval (Yvelines), a resident has been denouncing construction on the land of his immediate neighbor for several weeks. Facing its terrace, a 3.5 m wall was built at the dividing line at the beginning of September 2022. According to the resident, it should double in height and eventually reach seven meters, reports 78 Actu .

Two appeals filed

When he bought his house in 2021, the man mightn’t buy the entire land. The seller then separated the space into several parcels. The owner knew then that a construction might take place on the neighboring plot to his own but he did not expect a wall so close blocking the view and the light completely.

“How can we accept that? It’s inexplicable denounces today the inhabitant. How we can respect people by granting building permits that will inevitably harm. » He filed two appeals in court, one to have the building permit canceled for construction defects and non-compliance with the local intermunicipal urban plan (PLUi) and another for abnormal neighborhood disturbances.

A fully compliant license according to the town hall

A suspended summary has also been filed. The emergency procedure will be examined and judged by November 7 at the latest. For its part, the municipality claims that it cannot do anything. “From our point of view, this construction respects the PLUi which authorizes construction on the dividing line says an elected official. All the boxes are checked, we might not refuse this permit. »

The chosen one advises future buyers to always be well informed beforehand in order to “inquire regarding the risks that there may be in terms of construction” . The resident affected by the problem is now planning to sell his house but wants to pursue legal action first.
