Working in the United States Without a Degree: Legal Options through the H-2B Visa Program

2023-10-09 18:34:18

Working in the United States, legally, without a university degree is possible. As? Thanks to the H-2B visa program, which allows American companies to hire foreign personnel as long as it is for temporary jobs not related to agriculture.

To do this, the employer must demonstrate that “there are not enough American workers who are able, willing, available and qualified to perform the job,” explains the United States Citizenship and Immigration Services (USCIS).

Of course, unlike other visas, there is a maximum number of foreign workers that the country receives during the year, a number established by the US Congress.

“Congress has set the maximum number of H-2B visas at 66,000 per fiscal year, of which 33,000 are for workers who begin employment during the first half of the fiscal year (October 1 to March 31) and 33,000 for workers who begin employment during the second half of the fiscal year (April 1 to September 30)”, explains the USCIS page.

How long can I work with an H2-B visa?

A foreign employee will have a work contract for one year, depending on the case, but if the employer considers it necessary, he or she may request an extension of the work permit for another year.

However, the person cannot be in the US for more than three years. Once this time is up, the worker must leave the country for a period of three months. After that, he can apply for readmission as an H-2B Nonimmigrant, certifying that he has employment.
