Bad surprise for the Biden clan. Prosecutor and lawyers had nevertheless found an agreement to settle this case and keep Hunter Biden out of jail. But on July 26, the Delaware federal judge, appointed by Donald Trump when he was president, refused to approve it.

It is not yet certain that a trial will take place. At the end of his investigation, the special prosecutor will report to the Minister of Justice. If he does not follow Weiss’s recommendations, he will have to explain himself to Congress.

Republicans aren’t thrilled with Weiss’ nomination. “They find that he has not been aggressive enough so far. David Weiss has a reputation for respecting the rule of law, for being rather benevolent”, considers François van der Mensbrugghe, professor of law (Saint-Louis and ULiège).

Will the President’s election campaign suffer from this rebound? Not sure. “Biden is playing the transparency card, when he might have dismissed Weiss, appointed by Trump. He does not intervene, does not address the issue. We will have to see how far the Republicans will be able to exploit this affair”, asks the law professor.
