Why was Abdesalem L. not expelled? Exploring the Blame Game Between Schaerbeek and Nicole De Moor

This Tuesday, through the media, Nicole de Moor, Secretary of State for Migration, and the municipality of Schaerbeek blamed each other for this failure, presenting divergent versions.

Why was Abdesalem L. not expelled? Schaerbeek and Nicole De Moor blame each other, and their versions diverge

Bernard Clerfayt (Défi), mayor of Schaerbeek and minister of the Brussels government, immediately demanded “the resignation of Ms. Nicole de Moor (and the opprobrium of Sammy Mahdi), her predecessor”, due to “the failures in the registration of asylum seekers, in the transmission of information to local authorities and in the monitoring of dangerous people by the Immigration Office”.

He then specified that “the Foreigners’ Office had registered this person at an address in Schaerbeek without informing the municipality” any more than it had informed it when “he had been removed from this address.”

During the press conference organized on Tuesday, Nicole de Moor, however, contradicted these remarks. “On October 4, 2021, the Immigration Office sent the municipality of Schaerbeek a summary of the file of the person concerned (Abdesalem Lassoued) and there was an exchange of information,” she assured.

Bernard Clerfayt denounces “the false defense” of Nicole de Moor

Exchanges therefore took place between the services of Nicole de Moor and the municipality of Schaerbeek. ” This is a false defense of Mrs de Moor. This exchange of information was not taken at the initiative of the Immigration Office, but that of the municipality of Schaerbeek”, points out Bernard Clerfayt who insists on one fact: it is only seven months following the sending the order to leave the territory that the file mentioned by Nicole de Moor was transmitted to the Brussels municipality.

The purpose and origin of this file deserve attention. ”In September 2021, a lady of Belgian nationality presented herself at the Schaerbeek civil registry, Bernard Clerfayt tells us. She requests the transcription in Belgium of a marriage she contracted in Tunisia in 2017. A marriage with Abdesalem Lassoued… This request, made four years following the ceremony, arouses the distrust of our civil state, which fights once morest sham marriages . They decide to carry out an inspection. We ask the Immigration Office to provide us with information on this person, and we also contact the public prosecutor. It must be understood that the request to transcribe the marriage in Belgium might have allowed Abdesalem Lassoued to have access to Belgian territory.”

On October 4, the municipality therefore received a file regarding Abdesalem Lassoued.

“The King’s prosecutor informed us of the fact that Abdesalem’s marriage to his wife had been contracted in the husband’s absence! Only his father was present during the ceremony. The King’s prosecutor concluded that we might not not validate this marriage.”

“The sham marriage service of the Ministry of the Interior and the Foreigners Office responded to us in a two-page letter,” continues Bernard Clerfayt. This letter contained the journey of Abdesalem Lassoued, his unsuccessful requests for asylum in Norway, Sweden and Italy. There was also information regarding his wife, who had already been married before, and is the mother of a young daughter from a previous marriage (Editor’s note: the young girl who lived with Abdesalem Lassoued). For his part, the King’s prosecutor informed us of the fact that this marriage had been contracted in the absence of the husband! Only his father was present during the ceremony. The public prosecutor concluded that we might not validate this marriage.”

Nicole de Moor therefore told the truth. “She sent us information. But nothing in these aimed to know where to find Abdesalem Lassoued with a view to carrying out his expulsion, continues Bernard Clerfayt. Nicole de Moor’s services had sent an order to leave the territory to the Schaerbeek address… from where this person had just been removed. To make matters worse, this document was probably sent to the wrong address, because no one asked us to verify it, as is the traditional procedure. This order to leave the territory therefore returned to the Immigration Office with the mention ‘unclaimed’. They then considered the matter settled, without ever calling on the municipality of Schaerbeek.”

“Van Quickenborne told regarding the carbistouilles”

Bernard Clerfayt, quite upset, also criticizes the remarks made this Wednesday in committee by the Minister of Justice, who mentioned the prison sentence served by Abdesalem Lassoued in Sweden and his numerous requests for asylum in European countries. “If we had had this information, we would have had another image of the terrorist,” pointed out Vincent Van Quickenborne.

”Nicole de Moor, who was next to him during this press conference, nevertheless confirmed that she had sent us a report on Abdesalem Lassoued long before the attack. This report included precisely the information on these asylum requests, concluded the mayor of Schaerbeek. We also know that there were reports of radicalization. Mr. Van Quickenborne therefore spoke of carabistouilles.” The Minister of Justice also resigned this Friday evening…
