Mexico has a new mandatory day of rest

Mexico has a new mandatory day of rest. It was through a decree in the Official Gazette of the Federation (DOF) that President Andrés Manuel López Obrador established this new day of rest, which will be added to the holidays in the country.

According to the decree published on July 12, the reason for this new mandatory day of rest is due to a reform that came into effect on December 1, 2018, the day the president took office.

“The amendment to Article 83 of the Constitution came into force on December 1, 2018, so the aforementioned constitutional reform established a new political reality, which will be applied for the first time on October 1, 2024, in order to ensure normative coherence and harmonization between the Constitution and the Official Calendar,” the document reads.

Thus, it is stated that all persons holding positions and entities of the Federal Public Administration, whose work relations are governed by section B of article 123 of the Constitution, must observe the following days as mandatory rest days:

  • January 1st.
  • The first Monday in February, for February 5th.
  • Third Monday in March, to commemorate March 21.
  • May 1st.
  • May 5th.
  • 16 of September.
  • Third Monday in November for November 20th.
  • December 25th.

However, one more day has been added to them. It is October 1st, which will be taken as a mandatory day of rest, but only during the years in which there is a transfer of power.

That is, it may be applied this year due to the transition between President López Obrador and Claudia Sheinbaum.

As stated in Article 123 of the Constitution, Section B, this will only apply to the Powers of the Union and their employees.

Previously, this day was December 1 of each year in which there was a transition of power.
