Who is the new Chief Justice of Pakistan Yahya Afridi?

Justice Yahya Afridi is the third senior-most judge of the Supreme Court, who has been nominated by a special parliamentary committee for appointment to the post of Chief Justice of Pakistan.

Born on January 23, 1965 in Dera Ismail Khan, Khyber Pakhtunkhwa, Justice Yahya Afridi is scheduled to retire on January 22, 2030, but according to the 26th constitutional amendment, he will become the Chief Justice for three years.

Educated from Aitchison and Cambridge, Justice Yahya Afridi started practicing law in 1990 and was also appointed Assistant Advocate General of Khyber Pakhtunkhwa.

He graduated from Government College, Lahore, and also obtained an MA in Economics from Punjab University.

He received his LLM from Cambridge on a Commonwealth Scholarship.

Justice Yahya Afridi started practicing as a High Court advocate in 1990 and appeared as an advocate before the Supreme Court of Pakistan in 2004.

Justice Yahya Afridi, Justice Mansoor Ali Shah and the third judge of the Supreme Court Justice Athar Manullah have also been partners in the same law firm.

He was appointed as a judge of Peshawar High Court on 15 March 2010. He was the first judge from FATA, who was appointed as Chief Justice of Peshawar High Court on 30 December 2016. On 28 June 2018, he was appointed as a judge of the Supreme Court.

Justice Yahya Afridi had challenged the emergency of November 3, 2007 in the Supreme Court and later when the special court formed under Article 6 in which the case of Pervez Musharraf was going on, he was made the head of this three-member bench. It was objected by the lawyers that they have been petitioners against Pervez Musharraf’s initiative, so they cannot file this case.

After that, Justice Yahya Afridi recused himself from the case.

Justice Yahya Afridi had ruled against the eight-judge majority verdict in the reserved seats case and issued his dissenting note.

Justice Yahya Afridi was also part of the nine-member larger bench of the Supreme Court on the presidential reference against the execution of former Prime Minister Zulfiqar Ali Bhutto.

Justice Yahya Afridi had declined to join the three-member judges committee of the Supreme Court Practice and Procedure Ordinance 2024.

Justice Yahya’s father Umar Khan Afridi served as Political Agent (PA) erstwhile South Waziristan Agency (1968-1971).

Umar Khan Afridi was commissioned in the army and later transferred to the civil services.

The new Chief Justice will now hold office till October 25, 2029.
