In all these local authorities, where ceiling prices are set, real estate rental advertisements must evolve from 1is April 2022 if issued by real estate professionals. In addition to the monthly rent requested in large print, the advertisement must indicate the words “area subject to rent control”, give the “basic” rent (also called “reference rent”) and the “increased reference rent”, that is to say the maximum rent authorized except in special cases (it corresponds to the reference rent increased by 20%).
If the owner wishes to apply a rent supplement, the advertisement will indicate the mention “rent supplement” and the amount of the latter.
These elements, set by thestopped of January 26, 2022 relating to the information of consumers by professionals intervening in a real estate transaction, must better inform the tenant upstream and underline how much he might possibly save, in the event that there is an additional rent. And dissuade owners from applying these add-ons, by giving them visibility.
For the time being, these rules apply only to real estate professionals, but ads posted by individuals must also be subject to them very soon – an implementing text is expected shortly, according to the services of the minister responsible for Housing, Emmanuelle Wargon.
Three months to challenge
“The goal is also for more tenants to exercise their recourse options. But they don’t because they are afraid of not finding housing or do not want to come into conflict with their landlord,” thinks Corinne Jolly, president of From particular to particular.
The tenant can, in fact, contest an additional rent three months following the signing of the lease before the departmental conciliation commission and then in court. State services can also verify the application of the text, with the key to a fine of up to 5,000 euros for a natural person to 15,000 euros for a legal person. The Ministry of the Economy also hopes that the particulars indicated in the announcement will help its services to better control the accommodation rented above the ceilings.
