This morning, the arguments will begin in the trial for the crime of Fernando Báez Sosa. During this stage, which will last until tomorrow, The rugbiers will have the last chance to speak before the Oral Criminal Court (TOC) No. 1 of Dolores, before the judges give the verdict. The family of the murdered young man also confirmed his statement following the allegations. What might they say.
The so-called “last words”, a guarantee provided for in article 368 of the Buenos Aires Criminal Procedure Code, is the last act that the rugbiers accused of the murder of Fernando Báez Sosa will have to demonstrate during the oral trial.
In this sense, the expectation grows regarding what the defendants will say before the president or the president of the Court who will ask the accused person, under sanction of nullity, if someone has something to express and then the debate will be closed.
What is known is that it will not be a statement regarding the facts charged, like the one that the defendants have the right to provide at any time during the stage of receiving the evidence in the trial, but an instance that offers the possibility of carrying out some brief consideration once the performance of all the parties has finished.
In this sense, according to the five statements that exist and were recorded in the evidentiary stage, it is expected that the defendants continue to deny participation in the act and appeal for their innocence. But also, They might use the space to apologize and even acknowledge what happened on that night of January 18, 2020 in Villa Gesell.
Rugbiers: Who spoke and what has been said so far
In the trial, five of the eight rugbiers who with the same force had forged a pact of silence that lasted three years: Ciro, Lucas and Luciano Pertossi, Máximo Thomsen and Blas Cinalli. Ayrton Viollaz, Matías Benicelli and Enzo Comelli were silent.
The first to break the pact of silence between the accused was Máximo Thomsen. The rugby player, one of the most targeted by the rest of the witnesses, used his right to defend himself in one of the evidentiary hearings and apologized.
«I want to apologize because never in my life would it have occurred to me to kill someone. Never« he began by saying in his story.
After being remorseful, he said that he wanted to give his word since he considered that things had been said regarding him: «I spent three years hearing things from me in which I did not recognize myself, they spoke with a lot of hate“, he lamented.
THomsen said that he went to the bowling alley where the murder occurred following having «blowjob” on the beach with his friends. In addition, he explained that they were at the bar of the place, and that there was pushing.
«I hear that I organized and I am a leader, I would fight that it was one person once morest many. I didn’t see if there was one or more friends«. In addition, he pointed out that he became aware of death the next day.
The second to testify in court was Ciro Pertossi, another of the defendants. The rugbier used a video to deny some of the accusations that linked him to the murder.
«This boy is me. I don’t give that kick. When I realize that the boy (by Fernando Báez Sosa) is on the floor, I stop before«, declared Pertossi.
Also, he referred to an audio sent the morning of the murder, in which he is heard saying “Guys, don’t tell anyone regarding this”. Regarding this material, he said that there were people from Zárate who knew regarding the fight and he sent that audio so that the parents would not find out regarding the altercation.
During the last evidentiary day of the oral trial last week, Lucas Pertossi also wanted to testify before the Court. He assured that he never hit Fernando Báez Sosa and denied participating in an assassination plan. “I just went on vacation. I never meant to take anyone’s life“, said.
Blas Cinalli, another of the most targeted rugbiers along with Thomsen, continued following Pertossi’s statements. In his statement, too He denied involvement in the crime and denied the division of roles within the rugby team.
«I want to start by saying that I am very sorry for everything that happened, It was a terrible tragedy, a boy the same age died. There was no plan. There was no planning. There was no role, “he recounted and refrained from answering questions like his accused friends.
To complete the five testimonies that were collected at the hearings, another of those who spoke was Luciano Pertossi. Perhaps it was the most concise statement and that he pursued the same line as the other accused rugby players.
«I want to clarify something: I want to say that it was not where they show it, to clarify that it was on the other side. I was not there. I was not where they marked “, he maintained, in relation to the place where the experts located him in the videos. He also refused the inquiries.
