By accusing Philippe Bond of rapist during a podcast, comedian Thomas Levac exposed himself to reprisals from his colleague. Moreover, Mr. Bond announced on his Facebook page that he was initiating legal proceedings once morest Mr. Levac.

For Me Michel Larouche, a civil law lawyer, it is possible that Thomas Levac will have to pay the price for comments that seem gratuitous and that do not mention any specific fact or victim.
“The old adage of ”all truth is not good to say” takes on its full meaning here”, affirms Me Larouche.
Philippe Bond will first have to prove the fault of Thomas Levac. He will then have to prove the damage to his career, his reputation and his income, then demonstrate the causality between Mr. Levac’s statements and the damage he suffered.
Subsequently, Mr. Bond will have to demonstrate malicious intent on the part of Thomas Levac. If he succeeds in doing so, Mr. Levac would expose himself to punitive damages.
A judge will then be responsible for ruling on this case, taking into account freedom of expression, but also the right to reputation.
“We can not necessarily peddle all sorts of things regarding anyone by invoking the right to freedom of expression”, indicates Me Michel Larouche.
