VSach year, the Smic is subject to a revaluation on 1 January, taking into account the evolution of inflation observed for the 20% of households with the lowest incomes. “If the consumer price index increases by at least 2% compared to the index observed during the previous calculation of the Smic, then the minimum wage is automatically increased in the same proportions”, underlines the site of the Service Public. The minimum wage has seen two increases this year : 2.6% on May 1st then 2% on August 1st.

As a reminder, the Smic, or minimum interprofessional growth wage, corresponds to the legal hourly minimum wage. In other words, an employee cannot receive a remuneration hour below this threshold, regardless of the form of his remuneration, explains the Public Service site. Note: an employer in breach is liable to a fine of up to 1,500 euros. However, there are exceptions for apprentices and employees under the age of 18.

Collective agreements and company agreements can also define a minimum remuneration depending on the job held. In this case, it is the conventional minimum wage (higher than the minimum wage) that must be respected. We speak, for example, of minimum wage, to evoke the Smic practiced in this sector. But if the conventional minimum wage is lower than the Smic, then it is the latter that must be applied.
