The Chief Justice of Pakistan, Qazi Faiz Isa, during the hearing of the Faizabad execution case, made remarks and wanted to know who was the mastermind of the Faizabad sit-in. A 3-member bench headed by Chief Justice Qazi Faiz Isa is conducting the hearing, which includes Justice Aminuddin Khan and Justice Athar Minullah.
At the beginning of the hearing, Attorney General Mansoor Usman Awan came to the rostrum and the Chief Justice said to first see the order of the previous hearing. The Attorney General read the order of the previous hearing.
The Chief Justice inquired whether Absar Alam is here. The Attorney General replied that we were told they were on their way. In his remarks, the Chief Justice said that Absar Alam has made serious allegations against the employees of the Ministry of Defense and do you still want to withdraw the revision petitions.
The Attorney General replied that we have seen the allegations made by Absar Alam, we have formed a fact-finding committee. Chief Justice Qazi Faiz Isa asked what Absar Alam was at the time of the Faizabad sit-in. The Attorney General replied that Absar Alam was the Chairman of Pemra at the time of the Faizabad sit-in.
The Chief Justice instructed the Attorney General that it would be better to first read the instructions given in the Faizabad sit-in notice.
In the court, the Chief Justice asked when the federal government formed the fact-finding committee. To which the Attorney General replied that on October 19, the federal government has formed a committee which will review all aspects and give a report.
The Chief Justice of Pakistan said that the committee has not done any work yet. On this, the Attorney General said that the meeting of the committee has been held on October 26.
In the court, Justice Athar Minullah said that the Fact Finding Committee was formed under which law and what is its legal status?
The Chief Justice said that by forming a committee, only reports will continue, nothing will happen.
He said to the Attorney General that everyone including you is saying that Faizabad dharna decision is right, the committee formed by the government is like throwing dust in the eyes. Account will be taken.
Chief Justice Qazi Faiz Isa said that the entire country was held hostage by a party, a person was imported from abroad and taken hostage to the country and he returned, the government has no ability to investigate.
Speaking to the Attorney General, the Chief Justice said that if you ask the children, they can give a better answer than you.
Justice Athar Minullah inquired whether the affairs of the state are now being run according to the constitution.
The Chief Justice said that from the committee’s TOR, it seems that you have acquitted everyone, the court has given the entire history in the sit-in case, we had asked who was responsible for the sit-in.
He said that the government has not made even a single TOR of the committee correct, the government wants to make everyone responsible and no action should be taken against anyone, billions have been lost, but the government does not care.
The Chief Justice said that what will happen to the committee report? Will the committee report be presented to the cabinet? The report of the committee will be presented to the court so that action can be taken? We will not review the committee report.
The Chief Justice of Pakistan asked the Attorney General that why should the court do your work? It is the government’s job to implement the Faizabad dharna decision, the Additional Secretary is part of the Interior Committee, what will he do? How many bridges were destroyed? How much damage? Who will see all this?
In the court, Attorney General said that the government has formed the committee only for investigation, the committee will give recommendations along with its report.
Chief Justice Qazi Faiz Isa said that the fact finding committee is only a piece of paper, the country cannot be run with a piece of paper, tell us which rules of business and under which law the committee was formed.
The Chief Justice said that the way the government wants to run things will not happen, the court will declare that the government has not done anything in the Faizabad sit-in case, we want to know who was the mastermind of the Faizabad sit-in?
The Chief Justice said that the decision has not been implemented since February 6, 2019, so everyone here will say that no one can ask me whatever I do.
