In response to the harsh criticism directed at the Civil Procedure Code, recently approved by the House of Representatives, Minister of Justice Abdellatif Wahbi issued a strong response in a letter published by a daily newspaper. In it, he described these criticisms as “issuing absolute judgments, aiming to question the constitutionality of the project, according to the same methodology based on distorting concepts, belittling initiatives, and targeting all efforts made, in order to belittle the work of institutions constitutionally authorized to discuss draft and proposed laws.”
Wahbi stressed that the criticisms represent “abnormal interpretations, incorrect references to the chapters of the constitution, and narrow political and factional outbidding, which are likely to mislead public opinion and present perceptions far from the important legal provisions contained in the draft Civil Procedure Code, in order to achieve a higher goal, which is to ensure the protection of the rights of litigants on an equal footing.”
In the same context, lawyers are preparing to file a complaint against the Minister of Justice Abdellatif Wahbi to the Head of Government Aziz Akhannouch, demanding that the Head of Government intervene to soften the Minister of Justice’s positions and adopt new amendments to the draft Civil Procedure Code. According to “Sabah” sources, the lawyers, who belong to political parties from the majority and opposition, aim to overthrow the law or at least amend the controversial articles in it.
The names of lawyers from various political parties, including the government majority, appeared in a petition to drop the civil procedure, leading to the formation of the “Coordination of the Spring of Lawyers.” This coordination also includes lawyers from the Justice Minister’s own party, which poses an embarrassment to the tripartite leadership, which must decide between supporting Wehbe or the legal sector as a whole.
On the other hand, the Speaker of the House of Representatives, Rachid Talbi Alami, announced that he will refer the draft of the Civil Procedure Code to the Constitutional Court. Talbi Alami confirmed in press statements that the draft law will be referred to the Constitutional Court after it is voted on in the House of Advisors, to express its opinion. This step came after the media indicated that there is a trend towards referring the draft law to the Constitutional Court to resolve matters in a number of its articles that have angered the opposition, the Association of Bar Associations, and the National Authority of Judicial Commissioners.
These developments are an indication that the debate over the Civil Procedure Code has not yet ended, and that the positions of the various parties concerned will remain the focus of public opinion in the coming period.
