Abascal’s party is going to base its request for protection to the Constitutional Court on the fact that in its opinion the decision to return to the Justice Commission the opportunity to reconsider the content of the law implies a violation of the fundamental rights of its deputies. Specifically, they consider that in this way the president of the chamber fails to comply with article 23 of the Constitution, to the extent that this precept “guarantees the exercise of the parliamentary function under conditions of equality.”

In parallel, the Vox parliamentary group will register in Congress a letter addressed to the Chamber’s Board and another to the Justice Commission to request in both cases that the meeting of this parliamentary body called for next Thursday be suspended. The document supports the thesis that following the first vote, which reflected the lack of the majority required for the continuation of the parliamentary process, the amnesty law initiative should have simply fallen. On the other hand, the granting of a second opportunity to agree on the text represents, according to the appellants, an “arbitrary interpretation” of the Congress regulations.

Vox uses these same arguments in its appeal to the Constitutional Court. In this sense, he affirms that his interpretation of the chamber’s regulations in favor of the paralysis of the debate on the amnesty law “is consistent with the system of majorities (not achieved in this case) that is used as a control and guarantee of legality as well as a manifestation of the majority will through parliamentary representativeness.”
