Kochi – The District Consumer Disputes Redressal Commission has observed that the requirement of 24-hour hospital stay for insurance coverage is a violation of consumer rights at a time when hospitals are providing speedy treatment and discharge with the help of technology.
The observation of the commission is on the petition filed by Ernakulam Maradu native John Milton questioning his mother’s failure to get insurance following her eye surgery.
If 24-hour inpatient treatment is required but with the help of modern technology the treatment can be completed in less time then the insurance cover will be eligible.
The court also considered the Insurance Regulatory Authority’s circular that certain injections used for the treatment of myopia would be covered by insurance. The court also found that the same claim was allowed by the company to another policy holder while the petition of the complainant was pending.
The commission ordered to pay Rs 57,720 as compensation to the customer whose claim was rejected within 30 days. Commission President D. The order came from a bench comprising B. Binu, members Vaikom Ramachandran and T. N. Srividya.
