Viennese (16) tried to rape his grandmother

A jury sentenced the boy to 15 months in prison, two of which were mandatory. In addition, the youth was sent to a forensic therapy center because a child and youth psychologist certified that he was dangerous in accordance with Section 21 Paragraph 2 of the Criminal Code.

However, the boy’s placement in a correctional facility was conditionally waived, subject to a three-year probationary period and in conjunction with conditions. He was ordered to continue living in a supervised shared apartment, to continue his psychotherapeutic and psychiatric treatments, and to avoid alcohol and drugs. According to the report of the experts consulted, the young man’s personality is shaped by negative living conditions and numerous traumas from his childhood. The expert was able to prove that he had generally disturbed social behavior, as the expert explained to the Senate.

“You’re never going out once more!”

The incriminated incident occurred on March 3, 2024, shortly before the defendant’s 16th birthday. Due to problems with violence, he was living in a shared apartment, had no contact with his parents, but was allowed to spend the weekends with his grandmother. “We were basically on good terms with her,” reported the prosecutor. When he wanted to leave the apartment late at night and go to a club, the 60-year-old refused to give him the apartment keys, saying “You’re not going out anymore!”

This made the boy furious. A few minutes later, the angry, powerfully built defendant, who appeared to be older than 16, stormed into the woman’s bedroom, ripped off her underwear and tried to force sex, but the 60-year-old resisted violently. The woman finally managed to run to a window and scream for help. A passerby alerted the police and the then 15-year-old was arrested in his grandmother’s apartment. He was held in custody until May 28, before being released on bail.

“I became aggressive and mightn’t control myself”

In court, the defendant admitted to having acted violently once morest his grandmother because she wouldn’t let him leave the apartment at 1:30 a.m.: “I became aggressive and mightn’t control myself.” He also pulled her hair and pulled down her bra because he suspected she was hiding the keys there. He denied there was any sexual component. He said he didn’t know any more details and referred to an alleged blackout.

In the end, the Senate believed the grandmother’s version, which had been questioned contradictorily during the investigation. The video with her statements was played in the courtroom. “Her statement was conclusive,” the presiding judge clarified in his verdict. It was an attempted rape, “for whatever reason, be it as a demonstration of power or out of frustration.”

After a brief consultation with defense attorney Iris Augendoppler, the youth accepted the verdict. A key factor in this may have been the fact that he no longer has to go to prison, because his time in custody was counted towards the unconditional portion of his sentence. The public prosecutor also agreed with the court’s decision.
