On March 25, 2020, while the entire country had to deal with Covid and its extraordinary confinement, Xavier was the victim of a gratuitous attack. Heavily sentenced to a 30-month prison sentence, Mohamed did not come to defend himself in court. To finally have the opportunity, he filed an opposition to the judgment following spending a few days in prison. Shortly following the theft, Mohamed was caught by the police. He had clumsily inserted his Orange subscription into the stolen phone and lived just a few hundred meters from the scene of the theft. “The victim finally recognized him on a photo panel,” adds the prosecution.
This Friday morning, the 22-year-old young man admits the theft and threatens to “crash the victim”, but disputes the existence of the beatings described by the victim. Me Van Wymeeersch, his lawyer, pleads a work sentence instead of 30 months in prison. From now on, Mohamed seems to have changed and gained maturity, which was not the case at the material time. For the prosecution, this preferential measure would trivialize the extremely serious facts. A suspension of the sentence, with evidentiary conditions, is preferred. Judgment mid-December.
