Verdict after umbrella attack on soldiers: three years partially conditional

After an umbrella attack on an army comrade in Enns (Linz-Land district), the now 21-year-old attacker was legally sentenced to 3 years in prison in a jury trial on Thursday in the Steyr Regional Court for intentionally causing serious bodily harm, one of which was unconditionally sentenced. The 33-year-old victim, in whom the tip of the umbrella punctured the eye socket and entered the brain, has been severely disabled ever since.

After the retirement ceremony in the barracks Heres NCOs (HUAK) in Enns, some of the newly appointed non-commissioned officers went to a bar. There was plenty of alcohol that evening. According to witness statements, the accused is said to have started insulting the later victim in the bar. But this one reacted calmly. The place closed around 1:30 am on February 24th. Everyone made their way home to the barracks. On leaving, the accused grabbed an umbrella with a four-inch metal tip, opened it several times, closed it once more, and waved it around. Most recently he attacked the 33-year-old.

Witnesses say they saw the victim thrown and others stabbed in the face. The medical expert explained the injuries with a powerful blow from a short distance: the metal tip penetrated below the right eye. It pierced not only the skin and underlying tissue, but also the bone of the eye socket. A bone fragment penetrated five centimeters deep into the brain. The 33-year-old was bleeding and in severe pain, but did not want rescue or a doctor. The comrades took him back to the barracks in a taxi, where he lay down. Initially, the severity of the injury was not apparent. But throughout the rest of the night his condition deteriorated sharply. He was taken to the accident hospital in Linz and operated on immediately because he was bleeding dangerously on his brain. The alleged attacker was taken into custody.

The attacker made a full confession

Contrary to his previous statements, the man pleaded guilty to the full extent of the charges in the trial. He had previously paid the victim 10,560 euros in partial pain compensation and also announced that he would meet further demands. Because the victim mainly complains regarding the loss of fine motor skills in the left hand and paralysis of the arm. That alone was assessed by the court as a serious consequence of the crime. The 33-year-old also reports visual problems and problems with his left foot. He walks with a cane. An independent life is not possible for the time being. An upcoming rehab should bring improvement.

The approximately two and a half months in custody will be taken into account. There is the possibility of electronically monitored house arrest. When determining the penalty, the confession, the age at the time of the crime under 21 years and the previous criminal record were weighted as mitigating factors. The fact that he was aware of his aggressiveness under the influence of alcohol made it worse. He was asked to continue the psychotherapy he had started and was placed on probation. In addition, the victim was awarded a further 5,000 euros as symbolic pain and suffering. Further demands are to be expected. He wants to fulfill this when he now pursues the work he took up following the end of his military career.
