Soccer gives you and takes you and that is what Envigado seems to be suffering, the great Colombian soccer youth academy, which is seeing how one of its big bets is regarding to collapse.
Soccer is taking away from the orange team to give it to Millonarios, who scored a key victory in the ruling of the Dimayor Player Statute Commission in the Jefferson Martínez case.
What case was that? In summary: the Blues and the Antioquia team signed a transfer of the goalkeeper for 550,000 dollars, of which the Blues paid 150,000, corresponding to the first installment, and 400,000 dollars remained pending, which the Blues did not pay following not using of the option, which allowed the player to go to Bucaramanga for free and then to Junior, where he is today. Envigado alleged that there was a blow to his coffers, since Millonarios lost the commissions corresponding to those movements by not signing a contract.
Well, the Commission interpreted that the Bogotá club was always right and decided “not to accede to the claims of Envigado Fútbol Club SA” and declared that “Azul & Blanco Millonarios SA did NOT breach the Sports Agreement signed with Envigado Fútbol Club SA on June 27 of 2019”, for which there is no obligation to pay the 400 thousand dollars that were pending.
Basically, the ruling states that “the will of the player, understood as his free and responsible intention not to extend the contract, cannot cause harm to a bona fide third party such as Millonarios FC” and ensures that in the end the goalkeeper “took the decision that best suits their interests, such as: i) not continuing with Millonarios FC and ii) providing their services to Club Atlético Bucaramanga”.
Another of the pieces of evidence that Envigado presented had to do with a statement by President Enrique Camacho at the Millionaires’ General Shareholders’ Meeting on March 18, 2020, in which he recognized that the goalkeeper had been acquired by the club, but the argument of the The blue team was conclusive: “as of the date of said meeting, the Player had not presented the unilateral termination of the employment contract with Millonarios FC, so at that time, he was still linked to the institution and there was still the possibility of perfecting the option of purchase for the definitive transfer, whose term was agreed no later than June 26, 2020. The President of Millonarios FC, has always accepted that by the date of the meeting, the intention of the institution was to acquire the sports rights and economic conditions of the Player, making use of the Purchase Option, under the stipulated commercial and contractual conditions”.
In this way, the blue victory in the lawsuit seems definitive and Envigado does not seem sure of using his right to appeal. With Martínez in Junior, the costs and the wear and tear, sometimes there are games that simply cannot be won.
