Green light for the vaccination pass. This Sunday evening, the deputies voted in the last reading this device which replaces the health pass, with 215 votes for, and 58 once morest. From now on, it will be necessary to argue for a complete vaccination course – or in the process of being, several facilities being planned according to age or whether one is new to vaccination – to access a whole bunch of public places, such as bars, restaurants or cinemas.
Voted… but not yet in force. The concrete application of the law may not take place before the end of the week. Because some opposition politicians have announced to seize the Constitutional Council, starting with the Socialist parliamentarians. “We will put forward our arguments, specifies a socialist source in the National Assembly. It is a question of knowing if with this text, the fundamental freedoms of the French are guaranteed. The articles on which the Socialists intend to seize the instance will not be known until late this Sunday evening or Monday. Same story with the Insoumis, who claim to have mobilized the 60 deputies necessary to seize the Sages.
The Constitutional Council has, in normal times, one month to decide, except when the government considers that there is urgency, reducing the period to eight days maximum. According to our information, the executive believes that the Elders, if properly informed, should deliver their opinion on Thursday January 20. Result: the text might be promulgated on Friday January 21, with implementing decrees the following weekend. It is also in these decrees that we will know the precise contours of the vaccination pass, once morest which 54,000 people marched in France this Saturday.
As it stands, what does the passed law say?
For French people whose vaccination schedule is complete, already holders of the health pass, nothing changes and their QR Code in the “Tous anti-Covid” application remains valid. On the other hand, unless you have already been infected with Covid-19, a first injection is not sufficient to benefit from the vaccination pass. To encourage new entrants to the process, the vaccine pass can be validated between the first and second dose by antigen or PCR tests of less than 24 hours, this duration having to “very probably” be confirmed in the decree, indicates a source. at the Ministry of Health.
The places concerned by the vaccination pass are the same as for the health pass (restaurants, cinemas, swimming pools, interregional trains, performance halls, stadiums, fairs and exhibitions, etc.), with a few exceptions. Thus, the non-vaccinated will still be able to go to a health establishment for a consultation or to visit a relative, on presentation of a health pass validated by a negative test.
In addition, the vaccination pass concerns those over 16, the age at which a person can be vaccinated without the consent of their parents. Between 12 and 15 years old, the health pass always applies to enter an establishment open to the public (ERP), such as a restaurant or a cinema. As for children under 12, they are still not affected by the health pass, nor by its successor, despite the opening of vaccination from 5 years old.
Who can be exempted?
A doctor can attest to the contraindication to vaccination, for a history of allergy, or for serious adverse effects following the first injection, validated by an allergist or by a multidisciplinary medical team. This certificate must be sent to Health Insurance, which issues the QR code valid in all places subject to the obligation. Finally, some gray areas were removed during this final vote. In particular on the subject where senators and deputies clashed and which might give rise to a referral to the Constitutional Council: the control of the vaccination pass.
This Saturday evening, the Senate had thus deleted two provisions of the initial text, including that allowing the managers of public places to control the identity of the owners of the vaccine pass. Alas: the National Assembly having the last word, the deputies have, this Sunday, reinstated this measure. “An unbearable attack on freedoms”, tweeted the boss of the PS in the Senate, Patrick Kanner, while the communist Fabien Gay said his opposition to “a society where everyone controls everyone”. The other measure which the senators did not want, the establishment of an administrative fine for non-compliance by the employer with the rules of teleworking, was also reinstated by the deputies.
