Usa 2024 68 – Special Prosecutor Jack Smith he reformulated the charges against Donald Trumpfor the riot of January 6, 2021instigated by him, taking into account the sentence issued by the Supreme Court on the partial immunity enjoyed by a U.S. president when acting as president. Smith accuses Trump of trying to overturn the 2020 election.

The prosecutor’s move, not unexpected, comes just days before the possibility of doing so closes, because – in the opinion of the Department of Justice – it is too close to the presidential election of November 5. The former president’s lawyers said they were “not surprised” by Smith’s decision, but rather by the timing: they thought the indictment would not be refiled before the vote.

The Republican candidate, who is awaiting trial in three federal cases, all of which have been blocked by the Supreme Court ruling, calls the impeachment review a “farce” pushed “by his partner Kamala Harris.” On his social Truth, he calls it “the persecution of a political rival.”

“In an effort to revive the witch hunt in Washington, Special Counsel Jack Smith, in an act of desperation, has filed this ridiculous new indictment against me,” Trump wrote, denouncing “an attempt to interfere with the election and distract Americans from the damage Kamala Harris has inflicted on our country.” Democrats are committing “the worst sabotage of our democracy in history.”

Smith’s move comes a day after he appealed to a federal appeals court in Florida a decision by Trump-appointed lower court judge Aileen Cannonwhich, strengthened by the Supreme Court ruling, overturned the charges against the former president for having removed from the White House and refused to return hundreds of classified documents. According to Cannon, the investigation in itself violated the president’s immunity. According to Smith, however, Cannon’s decision is in conflict with case law and opinions expressed by the Supreme Court.

Still on the subject of interactions between politics and justice, a federal judge in Texas has blocked, at the request of 16 Republican-led states, the federal program that recognizes legal status to migrants married to American citizens, even if they entered the United States illegally.
