U.S. Customs and Border Protection determined Friday that Apple might use a new design to circumvent an import ban on new Apple Watch models stemming from its patent infringement litigation with medical monitoring technology company Masimo, according to a court filing Monday.
The import ban, issued by the US International Trade Commission (ITC), applies to Apple’s Series 9 and Ultra 2 Watches and took effect on December 26. The next day, Apple convinced a US appeals court to suspend the ban and has since resumed sales of the watches while challenging the import decision. Apple had argued that a proposed redesign would nullify findings that the watches infringe on blood oxygen reading patents owned by Masimo. Apple has not publicly described this redesign, which might involve updating the watches’ software. The customs agency’s decision might be overturned if the ITC disagrees with it. Masimo accuses Apple of recruiting its employees and stealing its pulse oximetry technology for use in Apple Watches. Apple countersued, calling Masimo’s legal actions a “move to pave the way” for its own competing smartwatch. The ITC banned Apple from importing and selling Apple Watches with technology to read blood oxygen levels, on the grounds that they infringe two of Masimo’s patents. Apple has integrated a pulse oximetry feature into its smartwatches since its Apple Watch Series 6 in 2020. Apple briefly halted sales of its latest Series 9 and Ultra 2 watches in the United States before Christmas due to the company’s decision. ‘ITC, although they remained available at other US retailers, including Amazon, Best Buy, Costco and Walmart.
