It’s January 1, 2020 and a few misfits choose a terrace on Place Léopold to drink a few beers. Kenny and his partner spent the night in a hotel located nearby. They drink with Bernard, a 65-year-old man, who shares the same misfortune as them. The trio is having fun, which doesn’t really please Fred, who arrives walking towards the table, quite upset. “What the hell are you doing with this pedophile? ” he says to the couple, pointing to Bernard.
The latter gets up from his chair, the tone rises. The belligerents are separated and everyone goes back to their room at the hotel. A few minutes later, they all meet in a room, in which Bernard is beaten up. Alessandro and Kenny’s partner lock themselves in the bedroom. They hear the sounds of knocking and breaking glass. Bernard’s face is bleeding, unconscious. The police intervene, as well as the emergency services.
No causal link
A month later, Bernard takes his last breath. An autopsy is requested by the investigating judge, to find out if there is a link between the blows and the death. The medical examiner is formal, the link is non-existent, so no murder, no blows resulting in death without intention to give it.
Kenny is sent back to the criminal court. He shows up there, or is represented by a lawyer, but his case is postponed several times. On the day of the trial, Kenny defaults. On March 10, 2023, he was sentenced to six months in prison.
Two key witnesses
Monday morning, he appeared, detained, before the vacation room of the criminal court. He claims that he did not receive his last summons to court, although he is homeless with a reference address at the CPAS, and that he did not strike Bernard. “He tried to separate Fred and Bernard”, declares Me Benzerfa, who pleads the acquittal.
The public prosecutor asks to confirm the sentence pronounced by default. On the one hand, he considers that the opposition is null and void. On the other hand, the deputy prosecutor believes that Kenny hit Bernard, in a room on the fourth floor of the hotel. “The two witnesses are formal, Fred and Kenny hit Bernard, they fought hard. The witnesses were so shocked that they took refuge in the bathroom. They did not dare to call the police, for fear of reprisals”, insists the representative of the prosecution. As for poor Bernard, his head was swollen and he was crying.
Finally, the prosecution notes that Kenny is not an altar boy. If he is detained, it is because he was sentenced to a five-year prison term for beatings and rape.
