United Front: Chief Justice Affirms Unshakeable Commitment to Upholding the Rule of Law

Chief Justice of Pakistan on Monday The Supreme Court In Islamabad Margalla Hills National Park, while withdrawing the contempt of court notice, remarked that ‘under the constitution, the executive and the judiciary are bound to obey the order of the Supreme Court.’

The Chief Justice further said that it is amazing that the civil judges are stopping the implementation of the orders of the Supreme Court. Did the civil judge commit contempt of court by ordering injunction? Action should be taken against such judges. The judge must first see whether relief is made on the claim or not.

Ahsan Bhawan, the lawyer of the restaurant, told the court that the building of Monal Restaurant in Margalla Hills was demolished. We had offered that the building should be used by the government.’ On this, Chief Justice Qazi Faiz Isa remarked that ‘what will the animals of Margalla Hills do with the building of the restaurant? We were told that by emptying the restaurant, the employees became unemployed. Then give the forest to the woodcutters. The business of woodcutters will be successful.’

Justice Shahid Bilal remarked that ‘Judge Inamullah issued a restraining order on the claim. The court fee of the claim was also not collected. The claim was not arguable without payment of court fee. The same is the case in the Subordinate Judiciary of the entire Punjab. Lawyers don’t let the judge read the claim and get an injunction.’

The Chief Justice said that ‘propaganda was done on social media against the court.’ Lawyer Ahsan Bhavan replied that ‘my client has nothing to do with propaganda. We have given possession of the respective place, vacated the place. The claim on which an injunction was granted to demolish the restaurant building was withdrawn on October 2.

The Chief Justice inquired that ‘Was the issue of commercial activities in Margalla Hills raised in any media or Parliament? The cannons are turned towards the judges. If our order is wrong, then attack it, instead of attacking the chief order, they attack the institutions. This is where timing is concerned. Please let me know when and before which bench such a case is to be heard.’

Lawyer Ahsan Bhawan, referring to the Article 63A case, said that many requests were made to hear the revision of Article 63A. 63 A revision was scheduled for hearing after two and a half years. Zulfiqar Ali Bhutto reference remained pending and no one heard. Will the decision be made by gangsterism in parliament, judiciary and media? Election decision was given in 13 days. No one abused the decision to hold elections. No one has raised the question of timing in the election case.’

It should be remembered that on September 24 last month, the district court of Islamabad issued an injunction on the demolition of the hotel building on the request of the contractor and stopped the Wildlife Management Board. The Wildlife Management Board was ordered by the Supreme Court to demolish the Monal and La Montana hotels in the Margalla Hills and restore the Margalla National Park to its original condition.
