Who has access to big data has a say. The examination in the National Assembly of the full employment bill allowed the adoption of an amendment of a legal nature, but whose institutional scope is evident for Unédic. Thanks to this amendment from Modem MP Anne Bergantz, Unédic, which is at the origin, will “have access to personal data collected by any institution or organization to which the latter has entrusted a mandate or delegation , the purpose being strategic management, analysis of the labor market and statistical monitoring or the fight against fraud. A decree taken by the Council of State will specify the terms of application.
The Court of Auditors points out the problem
Since the creation of Pôle emploi in 2008, recalls the explanatory memorandum, Unédic has delegated missions to Pôle emploi for the compensation part and Acoss for recovery. “This delegation deprived Unédic of access to granular nominative data relating to contributors and beneficiaries of unemployment insurance, essential data to ensure efficient management of the system,” we can read. In 2018, the Court of Auditors pointed out this problem preventing it from “evaluating the effects of the provisions negotiated by the social partners”.
In practice, Unédic teams have had access to the file of beneficiaries for a long time, but via an agreement with Pôle emploi. Tomorrow, any request for access – especially to certain strategic data from the Nominative Social Declaration (DSN) which the operator has the right to recover – cannot be refused.

“This need for legal clarification” is all the more necessary in view of the creation of France Travail, again according to the explanatory memorandum. The amendment also complements another adopted in committee which guarantees access to data shared within the future network of employment and integration stakeholders, of which “the digital aspect is central”.
Ensure a legal basis
The management of Unédic has anticipated this well: as a central operator, Pôle emploi will manage all the software (and therefore the data) of France Travail. The management of the joint association must therefore “ensure a legal basis” to access it, we can read in a summary of its digital strategy recently presented to the Board of Directors to which “Les Echos” had access .
“Without this legal guarantee and from the perspective of France Travail, Unédic feared depending on the goodwill of Pôle emploi or Dares for this or that data,” deciphers a good connoisseur of the unemployment insurance system.
Clearly, by matching all this data reinforced by the use of artificial intelligence, Unédic will be able to establish its financial projections, follow the path of the unemployed and therefore better evaluate compensation rules in an even more precise manner without risk. of marginalization.
