The Argentine Football Federation issued a statement yesterday clarifying some media confusion regarding the new regulations of the General Inspector of Justice (IGJ), which allow civil associations in the Buenos Aires municipality (such as football clubs) to become companies or associates from 2024 Work with them starting November 1st.

“The modifications to the local agency regulations of the City of Buenos Aires do not in any way impose or affect the social regulations of the AFA, and becoming a non-profit civil association remains a basic requirement for membership of the AFA”, the statement stressed.

Furthermore, the entity noted that “this is a good opportunity to clarify that neither the AFA nor its member entities object to the so-called SAD (Sports Public Limited Company) and/or that every civil association (club, regardless of its activities) can freedom to decide on the legal structure to be adopted; now, what the AFA and its member entities are opposed to because this is clearly unconstitutional, they want to force any private entity (i.e. the AFA and any civil association) to have a different legal structure than their current Legal structures linked once morest the charter set by its partners.

Dictators don’t like this

The practice of professional and critical journalism is a fundamental pillar of democracy. That’s why it bothers those who think they have the truth.

This view is supported by the federal judiciary, with the statement also mentioning that the Mercedes Federal Court suspended certain provisions of DNU 70/2023 that prohibit sports organizations from discriminating on the basis of legal forms and required them to adapt their Articles of Association to comply with the above provisions.

Furthermore, the Provincial Directorate of Legal Persons also declared invalid the meeting of the José Hernández Social and Sports Development Center seeking to transform it into a sports limited company, underscoring the important cultural and social role of the club as a civil association.

The public war over sports associations between the government and the Football Association is at its most intense.

A week ago, Mire posted on social media what he saw as a lack of competitiveness at club level and a certain “authoritarianism” in the entity led by Chiqui Tapia.

Mire relied on his campaign slogans: he spoke of “jobs” at the AFA and said he dreamed of an open regime that would encourage massive investment.

Prompted by the signing of the Basic Law, a regulation was published in the Official Gazette this week to allow civil associations to transform into SADs, endorsed by the General Inspector of Justice.

That is why the AFA reacted and issued a statement yesterday offering to clarify the situation. Although as we all know, there will be more rounds to the fight.
