TSJ Ruling: Authorization for Opponents to Exercise Public Functions

The Political-Administrative Chamber of the Supreme Court of JusticeTSJ, authorized citizen Leocenis García, to exercise public functions, following having imposed a claim for annulment together with an amparo action once morest administrative act No. 01-00-571 dated 8/31/2021, as announced the highest court through its website.

Likewise, the Political-Administrative Chamber of the TSJ announced the authorization of citizen Richard Miguel Mardo, for the exercise of public functions, without prejudice to any criminal liability that may arise.

The ruling details the appeal for annulment together with an action for precautionary protection that was filed by Mardo, due to the alleged material actions carried out by the Comptroller General of the Republic and the National Electoral Council (CNE).

Mardo was a representative of the Primero Justicia-Aragua opposition party and in 2011 he served as deputy to the National Assembly (AN). It should be remembered that the partial agreements signed on October 17 in the city of Bridgetown, Barbados, refer to the promotion of political rights and additional guarantees for all, and the protection of the vital interests of the nation.

The first partial agreement on the promotion of political rights and additional guarantees was expressed in response to the memorandum of understanding signed in Mexico on August 13, 2021, and in accordance with the guidelines of the Bolivarian Constitution and other laws of the country to agree on the necessary conditions so that the electoral processes are carried out with all the guarantees.

TSJ enables opponents to exercise public functions

It is important to mention that Leocenis García was accused of money laundering in 2014, when the prosecution alleged that he received funds from former President Uribe with the purpose of destabilizing the government through his media outlet, 6to Poder.

In the case of Richard Mardo, he was politically disqualified for not presenting his sworn declaration of assets to the Aragua state Comptroller’s Office, which is considered a crime, in addition to being part of the group that promoted violence in the guarimbas that existed in the country.

Actions that comply with established mechanisms

Likewise, the high court reported that Daniel Omar Ceballos Morales was authorized to exercise public functions, an action that complies with the mechanism established in the Barbados Agreement dated October 17, 2023.

Meanwhile, citizen Pablo Pérez Álvarez was also qualified to exercise public functions, following the Political-Administrative Chamber of the TSJ decided to suspend the effects of the disqualification that had been imposed on him for 10 years as a sanction in June 2015.
