Trump’s attorneys asked Manhattan Supreme Court Justice Arthur Engoron for the trial to be delayed by one or two days due to positive COVID tests from members of the attorney general’s team.
“We are truly in an outbreak, there is absolutely no reason whatsoever to proceed,” Trump lawyer Clifford Robert claimed.

The positive tests a few days ago caused the trial to go on hiatus Monday.
“The attorney general simply wanted to proceed with the trial as if nothing has happened, and in my view that’s simply irresponsible,” another Trump attorney, Chris Kise, said in court Tuesday.
Kise accused AG Letitia James’ office of “ignoring basic notice requirements” — which the AG’s office denied.

“As always, the Attorney General’s Office has followed and complied with CDC guidelines,” a spokesperson said in a statement. “Our office properly notified the court and defendants’ counsel, and the court decided to proceed with trial today. If there were any concerns, defendants might wear masks today or at any point, but they have opted not to.”
Engoron — who is deciding the trial and not a jury — overruled the objection from Trump’s side and the trial continued as planned.
