New York, Jul 1 (EFE).- Lawyers for former President Donald Trump (2017-2021) submitted a letter to a New York judge asking to overturn his recent criminal conviction and postpone his next sentence, citing the Supreme Court’s decision to grant partial immunity to former presidents, The New York Times reported Monday.
According to the American newspaper, Trump’s lawyers asked Judge Juan M. Merchan to postpone the sentence, scheduled for July 11, while he evaluates whether the Supreme Court’s ruling on Monday affects the conviction.
On May 30, Trump was found guilty of 34 charges of falsifying documents to conceal an adulterous relationship and avoid compromising his 2016 presidential bid.
While the case centers on actions Trump took as a candidate, not as president, his lawyers might argue that prosecutors built their case on evidence obtained during his time in office.
Throughout the trial, Trump’s legal team argued that some evidence presented came from his time as president and should have been excluded from the trial due to immunity protections.
The Supreme Court on Monday ruled for the first time that former presidents have broad immunity from prosecution, extending a delay in Washington’s criminal case once morest Trump over his efforts as president to overturn the outcome of the 2020 election that led to the storming of the Capitol.
The court also sent the case back to lower courts, reducing the chances of it being tried before the election.
The current president of the United States, Joe Biden, assured this Monday from the White House that the decision of the Supreme Court sets “a dangerous precedent” and puts at risk the principle of equality on which the country was founded by not establishing “limits on what a president can do.”
