The start of the argument was marked by a brief interruption following the discomfort of a juror. He was therefore replaced.
The attorney general spoke first. “You found him guilty of murder and aggravated rape. For murder, the law provides for 20 to 30 years of imprisonment, for rape with mitigating circumstances, 20 to 30 years of imprisonment. We are on the same scale. The law says that we should not pronounce two sentences but that the most important one is retained,” he explains.

No extenuating circumstances
He also insists on the importance of knowing whether Mickaël Van Haute has extenuating circumstances. “Mickaël Van Haute had to ensure the safety of little Néva. On the time factor, is the age of the victim, 22 months, a mitigating circumstance? No, it would even be quite the opposite. The location factor is Neva’s house, the place where she should feel safe but where she was with her tormentor. There are no extenuating circumstances either. »

It then comes to the personal aspect. “Néva needed to be comforted, she was hit. When we analyze the personality of a 22-month-old child, I don’t see any mitigating circumstances. On his mental responsibility, we heard from the psychiatric experts. He is fully responsible for his actions. And the alcohol excuse would be too easy. » The attorney general also comes back to his consumption of alcohol and drugs, explaining that he only works to pay for it.
“He received 26 convictions, cited in 80 facts. And he will say that we never did anything for him. » As for his family situation, the lawyer recalls the statements of Mickaël Van Haute’s brother and sister. “I had the same childhood, the same parents. » Yet both have no criminal records.
35 ans
The Advocate General therefore concludes that there are no mitigating circumstances. He is even asking for a 35-year prison sentence. “And I ask you not to go below 30 years. » He also wants a period of safety. “It is a security to be certain that part of this sentence will actually be carried out. You can pronounce a period between 15 and 25 years. » He asks for 25 years.
