In particular, the first phase concerns the regional units of Aetoloakarnania, Arcadia, Evros, Evia, Heraklion, Ioannina, Karditsa, Corfu, Larissa, Lasithi, Lesvos, Magnesia, Xanthi, Pieria, Rethymnon, Samos, Trikala, Fthiotida, Chania, Chios, while from October 31, 2024, all the other regional units of the country are included.

What stakeholders should do

In the procedural part, the application is made in a few simple steps.

More specifically, the entry of the applicants is done with TaxisNet codes, while the possibility of submitting the redemption application is also provided by an authorized person, who must fill in the A.F.M. of and to attach a responsible declaration of authorization from gov.gr or with a certificate of genuine signature.

Beneficiaries have one year to submit the application (until September 30 and October 31, 2025 respectively), while they must pay a fee of 300 euros, which is offset against the purchase price or returned if the application is rejected.

After the application is submitted and if it is approved by the competent committee within 5 days, a certificate of acceptance is issued which is communicated to the applicant and includes the description of the acquired property (area and boundaries), the applicant’s details, the acquisition price, as well as the amount of the lump sum and partial payment.

The purchase price is paid either in one lump sum or in installments in 60 interest-free, monthly installments with the amount of each installment being at least 100 euros. If there is a lump sum payment, a 10% discount is provided on the purchase price.

Discounts even reach 80% of the objective value (depending on the applicant’s personal and family situation).

It is noted that in the new framework for the acquisition of encroached public lands, the condition of the existence of a building for the submission of the acquisition application was abolished, the acquisition of a property with an arbitrary building is not allowed, while a necessary condition is the declaration of the property on the E9 form for at least five years before the application is submitted .

Conditions

A basic condition for the right to submit a redemption application is the uninterrupted possession of the property: for at least 30 years with a title, at least 40 years without a title, as long as the applicant uses the property as his main residence or as an auxiliary area of ​​it or to practice tourism, craft, industrial, commercial or agricultural activity, and to declare the property on the “E9” form for the last 5 years preceding the application, in order to make it clear that the applicants considered the property to be theirs.

It is clarified that an application can also be submitted for properties that do not have a building.

From the acquisition of the encroached properties of the State by the owners, it is estimated that at least 500 million euros could flow into the coffers of the State.
