High Court orders MYAirline to pay more than RM17.7 million in service fees

KUALA LUMPUR: The High Court has ordered MYAirline Sdn Bhd to pay over RM17.7 million in overdue airport service fees to Malaysia Airports (Sepang) Sdn Bhd and Malaysia Airports Sdn Bhd. Judicial Commissioner Gan Teck Chong today approved the two plaintiffs’ application for summary judgment against the defendant MYAirline in 2023. He also ordered the defendants to pay RM9,111,402.94 to the first plaintiff, Malaysia Airports (Sepang), and RM8,636,150.08 to the second plaintiff, Malaysia Airports Berhad. “The court also ordered the defendants to pay RM10,000 in court costs to the plaintiffs individually.” A summary judgment is when the court determines that a party is legally entitled to a judgment based solely on written submissions and legal arguments without a full trial or witness testimony. In his ruling, Gan Teck Chong said the two plaintiffs are entitled to charge the airlines for the services they provided. On November 9, 2023, the two plaintiffs filed an application for summary judgment, stating that the amount claimed from the defendants was still accumulating and not paid, and the airline did not contest the lawsuit. On November 24, 2023, MYAirline filed an application to strike out the lawsuit. It argued that the plaintiffs should first use the dispute resolution mechanism set out in Sections 74 to 78 of the Malaysian Aviation Commission Act 2015. Gan Tak Chong rejected MYAirline’s application to strike out the lawsuit and ordered the company to pay RM30,000 in court costs to the plaintiffs. The initial lawsuit was filed by Malaysia Airports (Sepang) and Malaysia Airports on October 18, 2023, alleging that MYAirline failed to pay six sets of service fees totaling RM17,747,553.02. The two defendants demanded that the defendants pay the outstanding costs of more than RM17.74 million, which is RM9.11 million 14.02.94 from the first defendant and RM8.636 million 150.08 from the second defendant, as well as general damages and other compensation deemed reasonable by the court.
