Tragic Double Accident: The Controversy Surrounding Erwan’s Death on the Belgian Coast

The news item occurred on the Belgian coast in July 2022. That night of July 13 to 14, Erwan, 17, was the victim of a double accident while returning from the evening on an electric scooter. The young boy, from Dilbeek and on vacation with his adoptive parents, was first hit by a truck which had fled. Secondly, a drunk driver, manager of a hotel, hit him, leaving him with no chance of survival.

During the second impact, the car stopped and the lady behind the wheel as well as two passengers immediately got out of the vehicle to go to Erwan’s aid. The two passengers, trained nurses, tried in vain to revive the teenager. If the driver was under the influence of alcohol, she claimed not to have seen the boy lying on the road.

After investigation, the driver of the truck that fled was identified. Two people will therefore appear shortly before the Bruges police court. But as our colleagues at HLN, they might be acquitted. “The first defendant must appear before the police court for involuntary manslaughter and drunkenness. The second for involuntary manslaughter and hit and run,” the prosecution specifies to the Flemish media.

But who is really responsible for Erwan’s death? That’s the whole debate. If death results from both collisions, both drivers will be held responsible. Except that this scenario poses a legal problem, a judge can only hold one person responsible for their death.

At HLN, an expert who prefers to remain anonymous, says: “It’s unlikely that they were both responsible for the death. It’s one or the other. And if there’s any doubt, it should play in favor of the two accused”. Are we therefore heading towards a painful acquittal for the victim’s family? Answer on November 13.
