“On the Giovanni Toti case, the Liguria Region is considering turning to the Constitutional Court for a conflict of attribution so as to put an end to yet another sensational conflict between ‘politics and the judiciary’”. This is what Luigi Bisignani wrote in an article for (June 30th edition) and today the Corriere della Sera relaunches the news, highlighting that “the Liguria Regional Council wants to request the intervention of the Constitutional Court because since May 7 it has been deprived of its representative with the house arrest of Giovanni Toti who, in fact, has been ‘interdicted’ from his position as Governor even though the law does not allow it during preliminary investigations”.
In recent days, the Court of Appeal also said no to the revocation of house arrest and now the Constitutional Court paper has once once more been discussed among the Ligurian councilors. “The appeal, which has no short time, would raise a conflict of attribution between the powers of the State, a theme that following the arrest was aired by the emeritus judge of the Constitutional Court Sabino Cassese in an opinion that was filed by the defense to the Constitutional Court. One of the arguments might concern article 289 of the code of criminal procedure which expressly provides that it is not possible to suspend a public official from an elected office, something that in fact happens with an arrest”, the newspaper explained. The next step is for the Council to decide to assign the role to a constitutionalist. The battle in defense of Toti continues: the center-right has no intention of abandoning him.
