Three Toronto residents were suddenly awakened Wednesday morning by police who broke down the door of their home in search of a man who had not lived there for nearly two years.
Bryanna Reilly and her two roommates were awakened at 5 a.m. by police who were searching their apartment for a man accused of vandalizing a bookstore in downtown Toronto.
The police had a search warrant for this 33-year-old man, who had already lived in the house… more than 20 months ago.
“It was terrifying, disconcerting and unexpected,” Ms. Reilly told the Toronto Star.
The three roommates also admitted to being perplexed as to how the search warrant was received in the first place.
“From my point of view, it looks like they didn’t take precautions at all,” said Vedanth Govi, one of the housemates. He wonders why investigators didn’t contact the homeowner to find out if the suspect still lived in the house.
Reid Rusonik, a criminal lawyer, told the English-language media outlet that while police can’t notify the homeowner for the sake of alerting the suspect, investigators might have done additional checks to make sure he was living there. this address.
Govi was still half asleep and half naked when a police officer entered his room. The officer questioned him “aggressively” while repeatedly showing him a photo of the suspect on his phone, before realizing the mistake he had made.
“A search warrant can only be approved if the perpetrator can demonstrate that there are reasonable grounds to believe that the suspect or evidence is at the address in question. Sometimes this information turns out to be inaccurate, but not necessarily because the officers did not exercise caution,” the Toronto police spokesperson told the English-speaking media.
“Searchs where nothing illegal is found and the grounds for the warrant are clearly incorrect are carried out all the time,” Rusonik said. And, we don’t know the extent of the problem, because the police are not required to disclose this information.
The suspect was finally apprehended with these accomplices later on Wednesday. They face charges of hateful mischief over $5,000.
