A woman in her 50s who installed a location tracking application and recorded a call to catch evidence of her spouse’s affair was sentenced to prison.
Chuncheon District Court Wonju Branch Criminal Division 1 (Chief Judge Shin Gyo-shik) sentenced A (54), who was charged with violating the Act on the Protection and Use of Location Information, and the Communications Secret Protection Act, to 6 months in prison, 1 year of probation and 1 suspension of qualifications. It was announced on the 29th that he was sentenced to one year.
The court ruled, “The guilt of infringing on the privacy and freedom of the victim, such as collecting the location of her husband, who is a spouse, and recording phone calls, is not light.” He continued, “I committed this crime on suspicion of an affair with my spouse, and the sentence was decided in consideration of the fact that location information and recordings were not leaked to the outside.”
A is suspected of collecting location information by secretly installing a location tracking app to find out the location of her husband B at her home in Hoengseong-gun, Gangwon-do, in October 2019. He is also accused of secretly recording a phone call between Mr. B’s girlfriend using the recording function of Mr. B’s cell phone to secure evidence of an affair in April of last year.
