The resident was prosecuted for breaching Section 27(a) of the Housing Ordinance by neglecting to provide the particulars specified in the asset declaration form, and was convicted at Kowloon City Magistrates’ Courts yesterday. Considering the seriousness of the case, the magistrate sentenced the defendant to 6 weeks’ imprisonment (suspended for 12 months) and a fine of 12,000 yuan. The Housing Department has terminated the tenancy agreement of the public housing unit.

In another case, a public housing applicant failed to declare the value of the land he owned in an application form submitted to the Housing Department in 2018. Subsequent investigations revealed that he owned a piece of land in the New Territories with an appraised market value of 1.4 million yuan at the time of the case, which exceeded the asset limit of the applicant’s family by 440,000 yuan.

The applicant was prosecuted for knowingly making a false statement in contravention of section 26(1)(c) of the Housing Ordinance and was convicted at Kowloon City Magistrates’ Courts yesterday. Taking into account the seriousness of the case, the magistrate sentenced the defendant to 6 weeks’ imprisonment (suspended for 12 months) and a fine of 5,000 yuan. The Housing Department has also canceled the public housing application.

A spokesman for the Housing Department reminded all public housing residents and applicants today (20th) that they must truthfully declare their income and assets.

The spokesman said that as the basis for determining rent and reviewing eligibility for continued residence in public housing, residents must accurately fill out income and asset declaration forms. Therefore, when providing the details specified in the declaration form to the Hong Kong Housing Authority, residents should first carefully read the contents of the income and assets declaration form and the instructions for filling out the form, and calculate their income and assets according to the specified method to fill in the relevant information. Otherwise, the resident may commit an offense under Section 26(1)(a) of the Housing Ordinance by knowingly making a false statement (if convicted, the maximum penalty is a fine of $50,000 and imprisonment for six months); or by neglecting to provide Particulars specified in the declaration form, in contravention of section 27(a) (up to a fine of $25,000 and imprisonment for 3 months if found guilty). The Housing Department will also recover the underpaid rent from the tenants due to incorrect information, and even take back the public housing flats they are currently living in.

The spokesman also reminded all public housing applicants that if they are convicted by the court of violating section 26(1)(c) of the Housing Ordinance, that is, knowingly making a false statement to the Hong Kong Housing Authority when applying for a public housing lease, The maximum penalty is a fine of 50,000 yuan and imprisonment for 6 months. The relevant public housing application will be cancelled, and the public housing units already occupied will also be taken back by the Housing Department.
