The Foundation Against Terrorism (FCT), deputy Sandra Jovel and the Vamos legislative bloc filed amparo actions against the budget increase of more than Q14 billion approved last Tuesday by the Congress of the Republic.
The interposers’ arguments point out that the right to interpellation was violated, because the interpellation of the Minister of the Interior, Francisco Jiménez, was interrupted in order to learn about the budget increase proposed by Bernardo Arévalo’s government.
Through an action for protection against the Constitutional Court (CC) the Foundation against Terrorism (FCT) intends that the budget expansion approved by the Congress of the Republic in the early hours of August 14th.
According to the FCTduring the process for the approval of the budget expansion requested by the government of Bernardo Arevalo There was “a flagrant fraud of law and violation of due process.”
The FCT He pointed out that these crimes were committed by including in the agenda of the session of the Congress the approval of said extension by means of an “anomalous” privileged motion, and “above an interpellation to a Minister of State”.
He also said that the expansion was approved without a technical opinion.
For this reason, he requested protection from the CC so that the aforementioned approval is suspended.
The president of the FCTRicardo Méndez Ruiz, announced that he requested protection from the CC on Wednesday, August 14, and was accepted for processing on Friday, August 16.
Other protections
The Vamos bloc filed an appeal before the Constitutional Court (CC) questioning the plenary session of the Congress of the Republic that stopped Jiménez’s interpellation and in which the budget increase was approved.
Jovel, for his part, filed an appeal because, in his opinion, his right to interpellation had been violated, since, in order to hear the urgent national budget increase, the procedure applied to Jiménez had been suspended.
The appeal filed by Jovel states that “the plenary session of Congress illegally limited the right of interpellation that we deputies have (…) through an illegal interruption of the interpellation process by approving an alteration of the agenda and approving the motion to waive the opinion and declare a national emergency” of the initiative that contained the budgetary extension.
Congress approved budget expansion
In the plenary session of the Congress On Tuesday, August 13, the interpellation of the Minister of the Interior, Francisco Jiménez, was resumed, but was interrupted by a privileged motion that opened the opportunity for 110 deputies to support the budget expansion that the government of Bernardo Arevalo I’ve been waiting for months.
