Threat Ban System in Belgium Sparks Opposition: Unions and Civil Society Organizations Fight Back Against Anti-Demonstration Law

In the ranks of the government, the Prime Minister, Alexander De Croo, did not wish to react to the announcement of the PS while the office of the Minister of Justice, Paul Van Tigchelt, who is carrying the bill, was content to moment to indicate that he will “watch” how the situation “will evolve within the government”.

The system which allows a judge to ban a “threat” from demonstrating is contained in a catch-all bill which includes other matters. The anti-thugs system was the subject of an amendment resulting from long negotiations within the government in June. The bill was adopted in committee but has not yet passed the plenary session. Questioned on Saturday in the Echo, the president of the PS, Paul Magnette, indicated that his party, although in the majority, would not vote for the text. He cites in particular the legal decisions taken in the context of the social conflict surrounding Delhaize.

“The orders issued in the context of this social conflict played a major role. We are seeing an increased judicialization of social conflicts. Some magistrates have clearly taken the side of the boss in the name of freedom of trade,” underlined Mr. Magnette.

In his eyes, rather than passing a “poorly made law”, we must remove the articles relating to the ban on demonstrations from the bill.

In opposition, the PTB welcomed this development. “Thanks to strong union, association and political pressure, the anti-demonstration law is now buried,” underlined the president, Raoul Hedebouw, on X.

The FGTB spoke of a “victory” and is waiting to see the attitude of the other majority parties. “Victory for the collective ‘Protesters not criminals!’ The PS declares that it will not vote for the Van Quickenborne law. The FGTB calls on other progressives to do the same and expects the ban on demonstrations to be removed from any justice reform project,” said the socialist union.
