With a vote of 79 votes in favor, 29 once morest and 24 abstentions, the Chamber of the Chamber approved resolution 904. It asks the President of the Republic to give the power to the National Consumer Service (Sernac) to process and resolve sanctioning procedures. In addition, he can dictate general rules and instructions of a mandatory nature.

The document observes that the Chilean market is made up of a countless number of small, medium and large companies, which strictly comply with current national legislation. However, there are large companies condemned for repeated abuses once morest their clients, workers and suppliers.

Among the most scandalous cases of abuses once morest the clients themselves, the initiative states, are the unilateral settlements of debts of the company La Polar. Also, the excessive charges in the administration by the Cencosud company. Added to this is the poor quality in the delivery of the agreed service of all telecommunications, airlines and land transportation companies. Added to the previous examples are the collusive agreements of poultry companies, tissue paper companies, pharmaceutical chains, shipping companies and even laboratories.

The resolution states that, although different public organizations acted in these events, the institutions were responsible. For this reason, an attempt was made to move forward legislatively to give the entity sanctioning powers, among other matters. However, such effort failed since the Constitutional Court declared the following powers unconstitutional: Process and resolve sanctioning procedures; Issue general rules and instructions of a mandatory nature; Receive consumer complaints and initiate investigation; Require from State agencies the background information they deem necessary for the fulfillment of their functions.

Last September, the Government began processing a message that, precisely, grants powers in matters of sanctioning procedures to Sernac. The text, described as extremely urgent (15 days for processing), is being analyzed by the Chamber’s Economy Commission.
