In addition, the Prosecutor’s Office requests payment of the procedural costs and that the injured party be compensated with the money allegedly swindled. The investigation of this case has been carried out in the Investigative Court No. 1 of Puertollano.

According to the Prosecutor’s Office in its brief, the accused JAGR, in execution of a preconceived plan and knowing from the beginning of his non-fulfilling will, for profit, announced through the social network Facebook the sale of several metal maritime transport containers . The complainant’s father, SFD, expressed his interest in them, so the accused agreed to a meeting of the parties in the town of Almagro, in order to close the legal transaction. The accused, boasting of his business solvency as owner of the company ‘Empresa de Construction GR’, even displaying the company’s website, managed to generate the erroneous trust of the other party, finally agreeing to the sale of five containers in total, making bank transfers in favor of the accused.

Subsequently, the letter continues, during the months of July, August and September 2022, through WhatsApp and even with a new personal interview, the accused, deceptively, presented causes for the non-delivery or delay that were not duly justified, until finally He cut off all communication with the injured party via calls and messages, so the facts would constitute a crime of aggravated fraud.
