The vaccination obligation – Ministry of Health and Prevention

For some professions, vaccination is mandatory

After adoption of the text by Parliament and following the decision rendered by the Constitutional Council on August 5, 2021, the persons subject to the vaccination obligation are the professionals below:

People working within:

  • Army health establishments and hospitals;
  • Health centers and homes;
  • Support systems for the coordination of complex health pathways mentioned in II and III of article 23 of law no. 2019-774 of July 24, 2019 relating to the organization and transformation of the health system;
  • Mobile care centers and teams;
  • Tuberculosis Centers (CLAT);
  • Free Centers for Information, Screening and Diagnosis (CeGIDD);
  • Preventive Medicine and Health Promotion Services;
  • Occupational health and prevention services;
  • Educational establishments or services which primarily provide adapted education and social or medico-social support for minors or young adults with disabilities or with adjustment difficulties: IME, IEM, ITEP, EEAP, IDA, IDV , INJA, INJS, SESSAD, SAFEP, SSEFS, CMPP;
  • Centers for early medico-social action (CAMSP);
  • Institutions and services for help through work (ESAT) and pre-orientation centers (CPO) and vocational rehabilitation (CRP): only professionals in these structures are concerned, and not people with disabilities who are beneficiaries of a contract for support and assistance through work;
  • Establishments and services that welcome the elderly or provide them with home help (EHPAD, PUV, RA, USLD, SSIAD, SPASAD, SAAD, day care centres);
  • Service residences;
  • Establishments and services, including medical care homes, which accommodate people with disabilities: MAS, FAM, accommodation homes, life homes, occupational homes, SAMSAH, SAVS, SSIAD, UEROS;
  • Establishments known as “specific medico-social” (LAM, LHSS, CSAPA, CAARUD, ACT);
  • Experimental establishments and services;
  • Residential homes only when they are dedicated to the reception of elderly or disabled people (which includes residential homes for the elderly, residences for people with mental disabilities, but excludes homes for migrant workers);
  • Inclusive habitats.

- Also concerned are persons exercising as:

  • Health professionals mentioned in the fourth part of the public health code (doctors, midwives, odontologists, pharmacists, pharmacy preparers, medical physicists, pharmacists, nurses, massage therapists-physiotherapists, podiatrists-podiatrists, occupational therapists and psychomotor therapists, speech therapists and orthoptists, medical electroradiology technicians and medical laboratory technicians, audioprosthetists, opticians-eyewear manufacturers, prosthetists and orthotists, dieticians), caregivers, childcare auxiliaries and paramedics, etc.);
  • Psychologists;
  • Osteopaths;
  • Chiropractors;
  • Psychotherapists;
  • People working in the same premises as the professionals mentioned above;
  • Students or pupils of establishments preparing for the exercise of these professions.

- Also concerned are employees of private employers receiving the personalized autonomy allowance (APA) and the disability compensation benefit (PCH);

- Are also concerned:

  • Firefighters and marine firefighters;
  • Aircrew and military personnel permanently assigned to civil security missions;
  • Members of approved civil security associations (for their civil security activities only, eg staff and volunteers of the French Red Cross working on activities other than civil security are not affected by the obligation);
  • Persons in charge of medical transport and transport on medical prescription (including taxis for journeys made under L. 322-5 of the Public Health Code);
  • The service providers and distributors of equipment mentioned in article L.5232-3 of the public health code.

On the other hand, the professionals of nurseries, establishments or support services for parenthood or establishments and child protection services are not affected by the vaccination obligation.

In accordance with the advice of scientific authorities, pregnant women can be vaccinated from the start of pregnancy. However, their vaccination cannot be required in the case of the obligation made to professionals before the start of the second trimester.
