For years, a 74-year-old woman bombarded the police emergency center in the Turnhout region with unnecessary calls. This septuagenarian called up to 928 times to complain regarding her neighbor’s noise pollution. But when the police officers went there, they never heard the slightest noise. A medical report dating from 2005 might explain the behavior of this resident of the province of Antwerp.
The prosecution did not request a concrete sanction in this case. The prosecution summoned AJ, 74, mainly because his behavior must finally stop. She was tried on Tuesday for “malicious use of communication tools”. “She made frequent and unnecessary phone calls to the police in the Turnhout region. In May 2020, she made the first call to complain regarding noise pollution, described as infrasound, coming from her neighbor’s home,” prosecutor Anouk Draulans told the court. “Between May 2020 and October 2022, she called the emergency switchboard no less than 855 times.”
No findings
The police went to the scene each time, but were never able to observe any noise pollution. Therefore, the officers made the trip unnecessarily. “Through her behavior, she also disrupted the proper functioning of the emergency center,” continued Anouk Draulans. “He was often told there was no point in calling because the police were never able to establish anything.” After a short period of calm, the septuagenarian called the emergency center once more unexpectedly. “We summoned her because the calls still haven’t stopped. I don’t know what punishment to ask for, but it’s important that this stops.”
The woman was represented by her lawyer Piet Van Gheem. As the septuagenarian was repeatedly asked to stop calling the emergency switchboard for the alleged noise nuisance, he admits the accusation of “malicious use of means of communication”. However, he considered that this accusation should not result in an effective sanction for the woman. “She is 74 years old, uses a wheelchair and has a clean criminal record. There is no need to burden him further by passing sentence,” the lawyer said.
Hearing loss and tinnitus
“A medical certificate shows that she has suffered from hearing loss and left-sided tinnitus since 2005. This may be the reason for the noises she hears. She constantly hears unbearable vibrations and buzzing,” continued Piet Van Gheem. AJ’s lawyer requests that the woman be placed on suspended sentence with probation. This means that she will not be sanctioned if she respects certain conditions. The main? Stop his calls to the police emergency center. The verdict in this case will be delivered on January 16.
