Will Agnès Buzyn be forcibly dragged by the gendarmes to the Paris court? Apparently absurd, the question could however arise for the three judges of the Court of Justice of the Republic (CJR) responsible, since July 2020, for the investigation into the management of the Covid-19 crisis by the executive.

According to information from Mondethe former Minister of Health (May 2017-February 2020) engaged in an unprecedented showdown with the CJR – the only body competent to investigate the acts committed by ministers during their mandate –, until refusing to defer to the last two summons of magistrates.

However, under article 122 of the Code of Criminal Procedure, the latter can issue a warrant of appearance, then, if necessary, a warrant of arrest, or even, finally, an arrest warrant, to any person refused to attend their summons.

If it is not certain that the three members of the CJR’s investigation committee take such radical measures, the episode testifies to the climate of tension in which this legal procedure takes place. Prosecuted since September 10, 2021 for “endangering the lives of others”, Mme Buzyn had seen with relief, on January 20, the Court of Cassation cancel this indictment, deemed offensive by the former minister.

Reinforced by this judgment of the supreme court, Agnès Buzyn, who remains however a witness assisted in the procedure, seems since determined to start a showdown with the judges. A few weeks after the decision of the Court of Cassation, on February 28, she challenged the three magistrates of the CJR after yet another hearing – she was questioned more than twenty times –, telling them that she put an end to the interrogation on her own and that she would no longer answer their questions.

The same day, his lawyers, Eric Dezeuze and Arnaud Mailhos, send the three judges a letter in which they explain that their client is “deeply sorry to have to say to [leur] committee, even though it had made itself available for the hearings scheduled for 20 and 27 March next, that it no longer wishes to be heard, will not appear spontaneously before [eux] on these two dates and will not answer the questions that would have been intended to be put to him..

“We can only regret it”

Mes Dezeuze and Mailhos recall that, ‘untilTo this day, Mr.me Buzyn systematically complied with the summonses of [leur] committee, and answered the very many questions that were put to him. She now has the feeling, despite her twenty interrogation reports, that these questions are only repeated cyclically, without any new element coming to motivate them and without any of the hundreds of answers or documents that she [leur] has already made does not seem likely to stop this cycle”.
