The unknown conflict between two Chilean startups that escalated to the Supreme

It is a long-running legal battle. In 2018, the main executives of Pasajebus (currently Kupos.cl) realized that trajectory (startup for buying bus tickets linked to Copec and whose investors are Christoph Schiess, Mountain Partners, among others) was using a similar web domain. to his (pasajesbus.com) and that, in his opinion, confused potential clients, since it redirected traffic to the competitor’s site, ruta.cl.

For this reason, they decided to file a lawsuit before the 25th Civil Court of Santiago in which they accused unfair competition. “The opposite seeks to confuse end consumers, taking advantage of our reputation, diverting customers,” reads the legal action.

Four years later -and following various instances- the conflict escalated to the Supreme Court: the highest court ruled, in March, that the previous judicial instances made a correct interpretation by ruling that Tours had indeed incurred in acts of unfair competition.

In mid-July Kupos returned to the fray and filed a second lawsuit once morest the firm linked to Copec. This time, they requested compensation for damages of US$ 2.2 million. On September 12, Tours answered the legal action and stated that it is a “gross attempt to obtain absolutely undue enrichment at the expense of my client.”
