The Trial of Trafigura: Corruption, Oil, and Swiss Justice

A country known to be corrupt, Angola, a risky sector, oil, and a firm specializing in raw materials trading, Trafigura: these are the ingredients that make up the trial which will be held at the Federal Criminal Court. On Wednesday, the Federal Prosecutor’s Office (MPC) issued an indictment following a secret investigation lasting three years, a surprisingly short period for this type of case. For the first time during a public trial, Swiss justice will examine the criminal liability of a company in matters of corruption. The federal prosecutor’s office traced payments it considers corrupt to the tune of 4.3 million euros, via a Geneva bank, as well as $604,000 in cash.

Presumed innocent, three defendants will be summoned to Bellinzona: the former boss of a subsidiary of the Angolan national oil company, Sonangol Distribuidora, responsible for the marketing of petroleum products; a former Trafigura employee and intermediary who allegedly made these payments; and finally, Mike Wainwright, former number two of the group, who allegedly granted part of these undue advantages.
