After the Climate and Resilience Law of August 22, 2021 allowing the social and economic committee (CSE) to be informed/consulted on “the environmental consequences of the company’s activity”three employers’ unions (Medef, CPME, Union of local businesses) and two confederations (CFDT, CFTC) signed a national interprofessional agreement (ANI), concluded on April 11, on a highly innovative theme for them “relating to ecological transition and social dialogue”.
In both cases, the “Never Enough” had a great time. Does the law provide for neither specific consultation nor new penal sanctions? Horror and damnation in the land of hyper-penalization. The fifty-page ANI does not begin with the forecast management of jobs and skills (GPEC) for the 2030s, but simply presents “legal landmarks”Then “practical benchmarks to nurture social dialogue” with “actions by area: human resources; organization of production; responsible purchasing », no new obligations? No interest.
But is this categorical imperative of the 21st century as well known to employers and shop stewards as working conditions or wages? Greenhouse-effect gas ? The biodiversity ? French companies are not limited to TotalEnergies and Danone, with their high-level experts, on both sides.
So yes, in line with these ANI, which should be a TGV for large, well-equipped companies, but an omnibus for SMEs, it is intended to be a modest instruction manual in the form of acculturation for the latter, many of which are renewing this year their social and economic committee.
“It is he who does, who knows”
With, in line with the socialization of our companies, a major change. « Having the mission to ensure the collective expression of employees allowing the permanent consideration of their interests in the decisions taken by the employer », the CSE has been dealing with two internal company issues since 1946: economic and social. This doubly internal dialogue becoming societal, the emergence of the theme of “ecological transition” modifies its raison d’être. But in how many of our SMEs are the two partners equipped to do so?
So, to avoid divisive ideological debates on this ideal theme for creating conflict, the ANI declines the principle of proximity: “He is the one who does, who knows ». Seek on the spot, in the establishment, solutions to very concrete problems, with the revival of the right of direct and collective expression, and local representatives. And a necessary training, on both sides and if possible jointly.
