“The Tariq Ramadan Trial: Lawyers Debate Manipulation and Evidence in Geneva Criminal Court”

2023-05-17 22:39:28

The lawyers of Tariq Ramadan and those of “Brigitte”, the woman who accuses the Islamologist of having raped her, crossed swords one last time, Wednesday, at the Geneva Criminal Court. For some, the defendant is innocent, for others a manipulative rapist.

Yaël Hayat, Tariq Ramadan’s lawyer, is convinced of this. In this case, “it is the man who has been wooed”. Ms. Hayat cites as proof the messages sent by “Brigitte to the Islamologist before and following that night in October 2008, during which the defendant allegedly sexually assaulted the complainant in a hotel room.

In this case, these messages are the only elements that have remained intact, recalled the lawyer. And they show a woman who assumes the role of “the temptress par excellence” before the facts, then, followingwards, of a woman who obsessively wants to keep the link with the one who raped her, writing dreaming of kissing him.

For Yaël Hayat, the complainant is part of “this alliance” of women disappointed and hurt by Tariq Ramadan. They discovered that they were not unique. “And from loving women, they will become vengeful women”, who think “we must teach a lesson” to the Islamologist.

Common sense

Guerric Canonica, another lawyer for Tariq Ramadan, stressed for his part that the mere reading of the complainant’s messages is enough to raise a reasonable doubt. He also appealed to the “common sense” of the court, before listing the inconsistencies and contradictions in the story of the one who says she was brutally raped.

The lawyer took as an example of implausibility the way in which “Brigitte” left the hotel following a night of confinement. She said she did not run away taking advantage of a moment of sleepiness from the Islamologist. No, she left the room while Tariq Ramadan, awake, was within a stone’s throw of the door.

The advice of the Islamologist deplored “an imaginary story which does not stand up to examination of the file”. The plaintiff did not go to her gynecologist either, she did not take a photo of her face even though she claims to have been hit and slapped, she did not keep any material element. “This is not serious”.

“manipulative rapist”

The tone was different Wednesday morning, during the pleadings of the lawyers of “Brigitte”. “We are here facing a manipulative rapist,” said François Zimeray. “There are rapists whose instincts are satisfied through the suffering of the victims, and this is the case of Tariq Ramadan”, continued the French lawyer.

Me Zimeray also said he was struck by “the fear and the tension” that permeated this case. “Brigitte” was the target of a number of threats and intimidation. “The militia of the net” was in ambush, inundating the complainant with “tick-tock tick-tock” and messages predicting an accident, said the French lawyer.

Robert Assaël, for his part, lingered on the dual personality of Tariq Ramadan. In public, he uses a chastened vocabulary, in the privacy of a hotel room, he can cover a woman with a torrent of insults and insults, as if he were “possessed” and “ lost control of himself.”

Speaking one last time before the verdict, Tariq Ramadan declared that he did not want this trial in Geneva to be the foil for what we want to do with him in France where he has become “enemy number one” in because of its name. He asked the court not to be influenced by the media and political noise that comes from France.

The Islamologist also asked to be judged as Mr. X and to forget that his name is Tariq Ramadan, to be treated without any privileges but as a citizen. “It’s been five years since my life completely changed,” he said. “I am innocent,” he concluded.

The Geneva Criminal Court will deliver its verdict on Wednesday May 24, at 11 a.m.
