On September 23, the Supreme Court of Justice issued a preventive detention order against Argentine President Javier Milei for “aggravated robbery” and six other crimes related to the case of the Venezuelan-Iranian plane that was detained in Buenos Aires and sent to the United States in February 2024.

In a statement, the Criminal Cassation Chamber of the TSJ explained that, following the request of the Public Prosecutor’s Office, the arrest warrant was issued against Milei, as well as against the Secretary General of Argentina, Karina Milei, and the Minister of Security, Patricia Bullrich.

The TSJ explained that the measure is for the alleged crimes of “aggravated robbery, money laundering, simulation of punishable acts, unlawful deprivation of liberty, unlawful interference in the operational safety of civil aviation and disabling of aircraft and criminal association.”

On September 18, the Attorney General Tarek William Saab reported the request and processing of the arrest warrant against Milei, after opening an investigation into the “theft” of the plane that had been held in Buenos Aires since June 2022.

For these investigations, the Public Prosecutor’s Office indicated that two specialized prosecutors had been assigned to deal with the matter.

Milei under investigation for alleged human rights violations

In addition to the case of the Venezuelan plane, Saab also referred to cases of alleged violations of human rights in Argentina by showing videos of riots during demonstrations in Buenos Aires.

For this reason, he reported that they would open a case against Milei and the Minister of Security of that country, Patricia Bullrich.

“The Public Prosecutor’s Office believes that we could be in the presence of serious human rights violations that could constitute crimes against humanity, so, inspired by the principle of universal justice and the catalogues of human rights provided for in international law, we have decided to appoint a prosecutor specialized in the protection of human rights to carry out the investigations,” said Saab.

During his speech, Saab also said that Milei’s government receives direct orders from the Atlas Network, a non-profit organization based in the United States that promotes the development of the free market economy in the world.

The Venezuelan prosecutor also rejected the Argentine government’s economic policies based on budget cuts and funding for universities, the closure of state institutions and the increase in public services.

On September 18, the Ministry of Foreign Affairs of Argentina repudiated the arrest warrants requested by the Venezuelan Prosecutor’s Office against President Javier Milei.

In a statement, the company questioned the validity of the case of the confiscation of the Venezuelan plane in Argentine territory as a justification for the criminal investigation. It indicated that the case of the Emtrasur Boeing 747-300 was resolved by the Judiciary without intervention by the Executive. Likewise, its shipment to the United States in January 2024 was in compliance with international agreements.

“The Argentine government reminds the Venezuelan regime that the separation of powers and the independence of judges prevail in the Argentine Republic, something that unfortunately does not occur in Venezuela under the regime of Nicolás Maduro,” the Foreign Ministry said.

In recent months, diplomatic relations between Venezuela and Argentina have deteriorated considerably due to the friction between Maduro and Milei.

In July, Argentina announced that it would rejoin the complaint against the Maduro government before the International Criminal Court (ICC), which had been filed in 2018 by then-Argentine President Mauricio Macri.
