The Supreme Court of Justice of Río Negro ordered the transfer of the monkey “Toti” to a sanctuary

The Superior Court of Justice (STJ) of the province of Río Negro today ratified a first instance sentence issued last February by the Family Judge, Ángela Sosa. The order establishes the transfer of the monkey “Toti” from the Bubalcó zoo “to a center and/or sanctuary for Great Primates”.

According to the members of the highest provincial court, the objectives are “safeguard their health and their individual and social quality of life“, as stated by the press team of the Judiciary.

The ruling left pending for the execution stage the formation of a team of experts, who must determine the real feasibility of the transfer, the conditions of the operation and the most appropriate place of destination. That task will fall on the Public Ministry of Defense and the NGO “Association of Officials and Lawyers for Animal Rights”, entities that filed the appeal.

The judgment focused on the expertise of a designated expert, who concluded that Toti “is currently and imminently at risk” and “suffers from a permanent anxiety disorder” due to the lack of socialization with others of its kind, with the encouragement of the public in the zoo and due to the environmental conditions of its place of accommodation.

“Proven the damage and the urgency of the required transfer given the threat to the life, quality of life and survival of the chimpanzee as a consequence of the conditions in which it is housed in the zoo of the required one, the situation that it has lived for years” Toti “must be attended to in order not to fall into the figure of animal abuse, as warned by the Attorney General”, detailed the majority vote of the Superior Court of Justice.

The amparo that was presented in 2020, was requested “the release” of Toti and “his subsequent and immediate transfer and relocation to a Sanctuary for Great Apes.”

Members of Afada proposed as possible destinations the Sorocaba Large Primate Sanctuary (Sao Paulo, Brazil) and the ANAMI Institute (Curitiba, Brazil).

The chimpanzee has been in Bubalcó since the end of 2013 and is 33 years old. He was born in 1990 at the Cutini Zoo, in Ezeiza. He was soon transferred together with his mother to the Florencio Varela Zoo (Buenos Aires). While still breastfeeding, the mother died. In 2008 he was transferred to the Córdoba Capital Zoo, until he finally arrived in Guerrico 10 years ago. According to his presentation, during his life he only had direct contact with two beings of his species, for short periods: his mother and the chimpanzee Coco, in Córdoba.
