The Repeal of Niger’s Anti-Migrant Smuggling Law: Impact on EU Migration Policy

The European Union’s controversial migration policy has suffered another setback in Africa following the military government in Niger repealed a law that banned the smuggling of migrants in the West African nation. All penalties imposed under the law have also been lifted, according to a decree published on Monday by junta leader Abdourahmane Tchiani. The provision was passed in May 2015 under significant EU influence and stipulated up to 30-year prison sentences for people who made a business out of transporting, accommodating or employing migrants. As a “reward” for the adoption of “Loi 36”, the EU provided the Nigerien government with hundreds of millions of euros in support. Among other things, Brussels also financed the patrols that monitored compliance with the new regulations.
